Are Axis home Care staff members independent contractors?

No they are not. All of our staff members are employees of Axis Home Care. It is important to us that our caregivers reflect the values and ethics we stand for. Each caregiver is professionally screened through extensive background checks. They are all bonded, insured, supervised and trained. Our caregivers are also covered by Workers’ Compensation insurance to protect our clients and their families.

 

What are the tax issues of hiring your own caregiver, without an agency? 

Should you become a private employer, you are required to pay Social Security, unemployment, and payroll taxes. Many home care aides represent themselves as independent contractors. It becomes your responsibility to make sure this caregiver is truly an independent contractor, and is therefore paying their own taxes. If the aide has not met his or her own legal tax obligations, the responsibility falls to you, the employer. This can become a serious obligation to you. It may involve interest on back taxes, civil fines, and the possibility of criminal penalties. If I hire a caregiver privately, without an agency, what are the potential Workers' Compensation and Liability issues?

YOU or the individual paying for the private home care would be held liable for any work-related injury that occurs during working hours. This can include the cost of ALL medical expenses. Should the aide become disabled, you would also be liable for any disability payments. This can be a huge risk on your shoulders. The home care industry is noted for work-related injuries. If your needs require lifting, bathing, toileting or transferring, imagine the risk you may be subjecting you or your loved one. Another factor to consider is the risks to communicable diseases. If your aide does not abide by the universal precautions required by all licensed agency personnel, you are putting you or your loved one at risk.
